Terms and conditions

1. THE AGREEMENT

1. These general terms and conditions form an integral part of the treatment agreement under Article 7:446(1) of the Dutch Civil Code between Loef Mondzorg and the client, hereinafter referred to as the Agreement.

2. PERFORMANCE OF THE AGREEMENT

1. Loef guarantees that the work it performs under this Agreement meets the standards that a good care provider must observe and complies with the statutory provisions (including the Dutch Medical Treatment Contracts Act, WGBO) as well as with generally applicable guidelines. 2. Dental treatments are medical treatments. The dentist has an obligation of effort, not an obligation of result. 3. Loef Mondzorg is entitled to engage third parties in performing the Agreement. Loef is not liable for the conduct of these third parties. 4. The client must at all times inform Loef fully and truthfully about the client’s general health and about circumstances that may affect the treatment.

3. COSTS

1. The costs of dental treatment are charged in accordance with the applicable UTP rates as set by the Dutch Healthcare Authority (NZa) and laid down in the tariff decision for dental care (www.NZa.nl). 2. The list of dental care fees can be consulted on Loef’s websites mentioned in the heading. The fees may be adjusted from time to time. 3. For all treatments totalling EUR 250 or more, Loef provides a cost estimate prior to treatment. 4. If the treatment has to be changed due to unforeseen complications during treatment, resulting in the estimate being exceeded, the additional costs will be charged to the client after consultation with the client. 5. Laboratory costs are charged separately. At the request of the client or their insurer, Loef will provide a specification. 6. Up to 1 year after treatment, Loef may invoice or change the code retroactively.

4. CANCELLING APPOINTMENTS

1. The client may reschedule or cancel scheduled appointments free of charge up to 48 hours before the scheduled time. If the appointment is not rescheduled or cancelled, or not in time, Loef will charge the reserved time and/or agreed treatment under code C90, taking into account the duration of the planned treatment, for which reference is made to the list of fees on the websites mentioned in the heading. 2. Loef is entitled at all times to reschedule or cancel scheduled appointments with the client.

5. CANCELLING TREATMENT

1. If, after a treatment agreement has been concluded, the client cancels the treatment in whole or in part, Loef is entitled to charge the client in full for all costs incurred by Loef and by third parties in connection with that treatment.

6. INVOICING

1. Payt handles invoicing for Loef. Payt’s payment terms apply. These payment terms have been filed with the Chamber of Commerce in Gooi en Eemland under number 04048143. The payment terms are also available for inspection at Loef, can be found on Loef’s website and are available from Payt (https://www.paytsoftware.com/nl/). 2. If invoices are no longer accepted by Payt due to payment arrears of the client, Loef is entitled to suspend further treatment or to carry it out only against immediate payment by the client.

7. COMPLAINTS

1. Complaints about the work performed or the invoice must be reported to Loef in writing by the client within 30 days of discovery, but no later than three months after completion of the work concerned. 2. A complaint as referred to in the first paragraph does not suspend the client’s payment obligation. 3. Loef will handle the complaint in accordance with the Complaints Procedure of the Royal Dutch Dental Association (KNMT). 4. If a complaint is justified and repair is possible, Loef will still carry out the work as agreed.

8. LIABILITY

1. Rights to compensation based on liability expire 1 year after the event causing the damage occurred. 2. The client cannot derive any rights from the calculation made by Zorgsom.

9. APPLICABLE LAW

1. Dutch law applies to all agreements between the client and Loef. 2. All disputes relating to the Agreement between the client and Loef, to which these general terms and conditions apply, will be settled by the court in Amsterdam.

10. OTHER PROVISIONS

1. If any provision of these general terms and conditions is void or voidable, this does not affect the validity of the other provisions.
